Terms of Service

METHODS OF DELIVERY: All software and downloads will be provided to you online via video, audio, download applications, documents or a combination thereof. Internet access is required. Blue Ocean Automators will primarily maintain correspondence via email to send you updates, but may also contact you via text message or telephone.

INTELLECTUAL PROPERTY: You agree that all configuration methods, downloads, and any other unique strategies used for the creation of your bot or bot components (flows, keywords, sequences, etc) are the property of Blue Ocean Automators and shall not be duplicated, replicated, resold or redistributed in any way. Violation will result in immediate termination of arranged agreement and bot services without refund and Blue Ocean Automators may prosecute to the full extent of the law.

PAYMENT POLICY: All systems are paid for on a month to month basis on a due date that will be agreed upon during negotiations. Should an unpaid balance due be created due to some circumstance, such as but not limited to, insufficient funds, credit card decline, or combination of payment methods, etc. this document then becomes a promissory note, a promise to pay any resulting balance within seven days of this agreement, except in the case for which special terms have been agreed to. Failure to pay a balance within 7 days of the agreed upon date will result in a pause of the bot and its services.

SATISFACTION COMMITMENT: Blue Ocean Automators is dedicated to satisfactory work, and we want you completely satisfied with your purchase. If for any reason you are not satisfied we will continue to work with you and provide appropriate resources to your satisfaction. We provide a full refund policy for the first 30 days of service, so long as a request for that notification is received in writing by 11:59 PM ET of the 30th day after the signing of the work agreement.

LIMITATIONS OF SERVICE: You hereby acknowledge that you are purchasing materials, software, and our assistance with your marketing plan. You are not purchasing a franchise, security, business opportunity, affiliation, or association. We will not provide customers to your business. No additional support from Blue Ocean Automators other than that expressly promised should be expected.

RESULTS VARY: No two businesses will receive the exact same results through chatbots, as there are a plethora of variables, both within and beyond control, influencing a business at any given moment. You agree to hold Blue Ocean Automators and its representatives harmless from any and all results or lack of results.

INDEMNITY: Blue Ocean Automators does not provide legal, financial, or other professional advice. Blue Ocean Automators specifically disclaims any liability for the use and/or application of its products and services. Review of any applicable agreements by legal counsel is encouraged. You agree to bear full responsibility of your own activities providing Blue Ocean Automators full indemnity including performance of software, apps and websites.

NEEDED PROGRAMS: Blue Ocean Automators does not provide needed software such as ManyChat or other marketing platforms. Though Blue Ocean Automators will assist in the creation of those accounts, you will be ultimately responsible for creating and paying for your own accounts. Having an email and social media marketer is also recommended.

ASSOCIATIONS: Blue Ocean Automators is not officially endorsed by Facebook or ManyChat. Facebook and ManyChat brands and logos are trademarks of their respective owners. Blue Ocean Automators is not in control of or liable for any changes to the function, access, practices or policies of either Facebook or ManyChat, or of any other recommended product or service.

RECOMMENDATIONS: You may be exposed to additional products or services which may or may not be affiliated with Blue Ocean Automators. It is recommended that you conduct your own research before purchasing any 3rd party product or service. YOUR PRIVACY Blue Ocean Automators will not share, sell or distributer your personal information (email, phone number, Facebook data, etc) in any way. Blue Ocean Automators does reserve the right to share your results in the form of a case study and any feedback provided to Blue Ocean Automators may be used as marketing testimonials.  

JURISDICTION: This agreement shall be deemed to have been made in the State of Delaware and as such, any court actions shall be brought to Delaware. In any litigation arising out of this agreement, the prevailing party shall be entitled to reasonable attorneys' fees and costs.
